Buying and Selling Property

Secure real estate transactions in Spain

Buying or selling property in Spain requires knowledge of local legislation and careful document management. We help you through the entire transaction process from start to finish.

Purchase process steps

Buying property in Spain proceeds as follows: making an offer, reservation agreement (contrato de reserva), contract (contrato de arras), transaction at the notary, and registration in the property register (Registro de la Propiedad).

Required documents

The buyer needs a NIE number, passport, and a Spanish bank account. The seller needs ownership documents, energy certificate (certificado de eficiencia energética), and possible permits. A debt-free certificate (certificado de cargas) is also needed from the land registry.

Taxes and costs

Property purchase involves several costs: transfer tax (ITP) 8–10% for used properties, or VAT (IVA) 10% for new properties. Additionally, notary fees, registration fees, and possible real estate commission. Total costs are about 10–13% of the purchase price.

Due diligence

Before the transaction, we recommend a thorough background check: verifying property register information, investigating debts and encumbrances, checking building permits, and clarifying the situation of any tenants. This protects the buyer from surprises.
